Overview

Welcome to the GoemonYae Trading System ("GYTS"). By accessing our website, Discord community, TradingView indicators, YaeBot, or any other products or services we offer (collectively, the "Services"), you agree to comply with and be bound by the following terms. Please read them carefully.

Like our multi-layered trading algorithms, these terms are structured to provide clarity, precision, and protection for all participants in our ecosystem.

Definitions

For clarity and precision in our agreement:

• "GYTS", "we", "us", or "our" refers to GoemonYae Trading System, a brand of [LEGAL ENTITY NAME], a company registered in The Netherlands.
• "Services" refers collectively to our website, YaeBot functionality, TradingView indicators (Community and Professional Editions), Discord community, and any other products or services we offer.
• "User", "you", or "your" refers to any individual or entity accessing or using our Services.
• "Algo Apprentice Path", "Goemon Warrior Path", and "GoemonYae Master Path" refer to our different subscription tiers, ranging from free access to premium services with varying levels of access to our Services.
• "Community Editions" refers to our freely available TradingView indicators which may or may not be open source. "Professional Editions" refers to our subscription-based premium TradingView indicators and related services.

Account Responsibilities

As precise inputs lead to accurate trading outcomes, your account information must be maintained with equal care:

• You are responsible for maintaining the confidentiality of any passwords associated with your access to our Services.
• You agree to notify us immediately of any unauthorised use of your account or any other breach of security.
• You must be at least 18 years of age to use our Services.
• You are responsible for all activities that occur under your account.

Your account serves as your identity within our ecosystem—protect it with the same vigilance you would apply to your trading capital.

Subscription Terms

For users of our premium services:

• Subscriptions are processed through our third-party payment processor, Whop.
• Subscription fees are charged in advance on a monthly or annual basis as selected during signup.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Cancellations take effect at the end of the current billing period.
• Price changes will be communicated at least 30 days in advance of implementation.
• Refunds are processed in accordance with our Refund Policy section below.

Like a trading strategy that must adapt to changing markets, we reserve the right to modify our subscription offerings and pricing with appropriate notice.

Refund Policy

Our approach to refunds mirrors our trading philosophy of clarity and defined parameters:

• Due to the immediate access granted to our proprietary digital content and intellectual property upon subscription, we generally do not offer refunds. This policy is based on the nature of our digital services.
• For Consumers in the European Union: You have a statutory right to withdraw from your subscription within 14 days of purchase. However, when you subscribe to our Services, you provide your express consent to begin the supply of digital content immediately and acknowledge that you thereby lose your right of withdrawal.
• Notwithstanding the above, we may consider refunds for annual subscriptions on a case-by-case basis within the first 14 days if the Services are demonstrably non-functional or inaccessible due to a fault on our part.
• All refund requests must be submitted through our official support channels, such as our Discord server or by email to support@goemonyae.com.
• Any approved refunds will be processed through the original payment method.

We view our subscription as a commitment to mathematical precision in trading—a value proposition that extends beyond simple transactions.

Intellectual Property

Our trading algorithms and methodologies represent years of mathematical refinement and development:

• All content, code, algorithms, indicators, methodologies, and related materials provided through our Services are the exclusive property of GYTS or its licensors.
• You are granted a limited, non-exclusive, non-transferable license to use our Services for personal or internal business purposes only.
• You may not reverse engineer, decompile, or disassemble any aspect of our Services.
• You may not distribute, lease, license, sell, or otherwise commercialise our Services or content without explicit written permission.
• Community Edition TradingView indicators, when published as open source, may be modified for personal use, but redistribution requires attribution and must not be for commercial purposes.
• The methodologies, mathematical models, and algorithms underlying our Services (particularly YaeBot) constitute trade secrets and proprietary intellectual property, even when their outputs are shared with subscribers.

Like Goemon's prized tools, our intellectual property represents the essence of our craft—we protect it accordingly while sharing its benefits with our community.

Service Availability and Performance

In the spirit of transparency that guides our mathematical approach to markets:

• YaeBot operates on dedicated hardware hosted in the Netherlands, not on cloud infrastructure. This may impact availability and performance in ways different from typically cloud-hosted services.
• We do not provide a Service Level Agreement (SLA) or uptime guarantee for any of our Services, particularly YaeBot.
• Occasional maintenance, network issues, power outages, or other technical challenges may temporarily impact YaeBot's availability.
• We strive to maintain high reliability and timely communication about any service disruptions through our Discord community.
• Our commitment is to apply the same mathematical precision to service restoration as we do to our trading strategies—prioritising accuracy over haste.

Like market conditions that require adaptive strategies, our service infrastructure requires your understanding of these operational parameters.

User Content

Within our Discord community and other interactive aspects of our Services:

• By posting content, you grant GYTS a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with our Services.
• You are solely responsible for content you post and its legality, reliability, and appropriateness.
• You agree not to post content that is illegal, abusive, threatening, defamatory, invasive of privacy, or otherwise objectionable.
• We reserve the right to remove any content at our discretion without notice.

Our community, like our layered trading approach, thrives through diverse, respectful contributions that enhance collective understanding.

Disclaimer of Warranties

With the mathematical honesty that guides our trading approach:

• Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not guarantee that our Services will be uninterrupted, error-free, or completely secure.
• We make no warranties regarding trading results, as market conditions are inherently unpredictable.
• Technical indicators and trading algorithms, even when mathematically sound, cannot guarantee profits.

As markets contain inherent uncertainty, our indicators and algorithms—despite their mathematical foundation—operate within probabilistic frameworks rather than deterministic guarantees.

Educational Content Disclaimer

Our educational materials, including but not limited to YouTube tutorials, Discord discussions, and TradingView content:

• Are provided for educational and informational purposes only.
• Do not constitute financial advice, investment advice, trading advice, or any other advice.
• May display or discuss hypothetical performance or specific trades, which may not be replicable and are shown solely for educational purposes.
• Should not be interpreted as promises or guarantees of performance.
• May include forward-looking statements or opinions that represent our current thinking but are subject to change without notice.

We apply mathematical rigour to our educational content, but the interpretation and application of this content is ultimately your responsibility. As Goemon adapted to changing circumstances, you must exercise independent judgment and adapt our teachings to your specific situation.

Risk Disclosure

In alignment with our value of proof over claims:

• Trading financial instruments involves significant risk and may not be suitable for all investors.
• Past performance of our indicators and systems is not indicative of future results.
• You should carefully consider your investment objectives, financial situation, and risk tolerance before trading.
• We strongly recommend consulting with a qualified financial advisor before making investment decisions.

Even the most rigorous mathematical systems must account for risk—our approach embraces this reality rather than dismissing it. Like Yaezakura's petals, resilience comes through acknowledging and adapting to changing conditions.

Limitation of Liability

With defined parameters that form the foundation of our relationship:

• To the maximum extent permitted by law, GYTS shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages.
• This includes, but is not limited to, damages for loss of profits, goodwill, data, or other intangible losses.
• Our liability is limited to the amount you paid for our Services in the 12 months preceding the claim, or €100, whichever is greater.
• These limitations apply even if GYTS has been advised of the possibility of such damages.

As precise traders set clear risk parameters, we establish defined boundaries for our service relationship.

Termination

Either party may conclude our agreement under these conditions:

• You may terminate your use of our Services by cancelling your subscription and discontinuing use of our products.
• We reserve the right to terminate or suspend your access to our Services at our discretion, with or without notice.
• Upon termination, your right to use our Services will immediately cease.
• All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, warranties, disclaimers, and limitations of liability.

Governing Law & Jurisdiction

As mathematical formulas require consistent interpretation:

• These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.
• Any disputes, claims, or controversies arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, The Netherlands.
• For consumers residing within the European Union, this choice of jurisdiction does not deprive you of the protection afforded to you by mandatory provisions of the law of your country of residence. You may also be entitled to bring proceedings in the courts of your country of residence.
• The European Commission provides for an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in an online dispute resolution procedure.

This multi-layered approach to jurisdiction reflects our commitment to legal clarity while respecting the diversity of our global user base.

Changes to Terms

Like markets evolve, so too may our terms:

• We reserve the right to modify these Terms at any time.
• We will provide notice of significant changes through our website or Discord community.
• Your continued use of our Services after such modifications constitutes your acceptance of the revised Terms.

We approach changes with the same transparency and precision that guides our trading methodology.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.
